Terms of Service

These Terms of Service ("Terms") govern access to and use of ThirdEyee, a workforce tracking and HR platform operated by ThirdEyee Technologies Pvt. Ltd. ("ThirdEyee," "we," "us"). By creating a workspace or using ThirdEyee, you agree to these Terms on behalf of yourself and, if applicable, the company you represent.

1. Acceptance of Terms

By signing up for a ThirdEyee account, installing the desktop agent, or otherwise using the platform, you confirm that you have the authority to agree to these Terms — either for yourself or on behalf of the company that employs you.

2. Description of Service

ThirdEyee provides a desktop agent and web platform for tracking work activity, managing HR functions such as leaves, payroll, and projects, and generating productivity insights. Features available depend on your company's plan and the settings your company's admin has configured.

3. Accounts & Registration

• The first account created for a company automatically becomes that workspace's Admin, and is responsible for managing the account and its users.
• New employee accounts must be approved by an Admin, Manager, or HR account with the right permissions before they can sign in.
• You're responsible for keeping your login credentials confidential and for activity that happens under your account.
• Company sign-in may be done via email and password, or through Google or Microsoft single sign-on where your company has enabled it.

4. Subscription, Trial & Billing

• New workspaces receive a 14-day free trial automatically, with no payment details required to start.
• After the trial, continued use requires an active subscription, billed at ₹499 per approved user per month (or the then-current published rate).
• Subscriptions can be managed, renewed, or cancelled at any time from Settings → Subscription within your account.
• If a subscription lapses, your workspace retains access to the billing and renewal screen so an Admin can resolve it — other parts of the account may be restricted until renewal.
• Fees are non-refundable except where required by applicable law.

5. Acceptable Use

You agree not to:

• Attempt to reverse engineer, decompile, or circumvent any part of the platform, including the anti-cheat or security systems
• Access accounts, data, or workspaces you're not authorized to access
• Use the API, webhooks, or any exported data in a way that violates applicable law
• Interfere with the platform's normal operation or attempt to disrupt service for other companies using ThirdEyee

6. Your Company's Responsibilities

If you're deploying ThirdEyee to track your own employees, you — not ThirdEyee — are responsible for:

• Complying with applicable local labor, privacy, and employee monitoring laws in the jurisdictions where your employees work
• Informing your employees that monitoring software is in use, where required by law or good practice
• Configuring tracking settings (such as screenshot use) in a way that's lawful and appropriate for your workforce

ThirdEyee provides the tools; how your company configures and uses them is your company's decision and responsibility.

7. Data Ownership

Your company owns the data generated by its own use of ThirdEyee — activity logs, timesheets, project data, and everything else tied to your workspace. We process that data on your company's behalf, as described in our Privacy Policy.

8. Intellectual Property

The ThirdEyee platform, including its software, design, and branding, is owned by ThirdEyee Technologies Pvt. Ltd. Nothing in these Terms transfers ownership of the platform itself to you — you're granted a right to use it under your subscription, not a license to the underlying software.

9. Service Availability

We make reasonable efforts to keep ThirdEyee available and performing well, but we don't guarantee uninterrupted or error-free service. We may perform maintenance, and we'll aim to keep disruption to a minimum when we do.

10. Termination

• Your company can cancel its subscription at any time from Settings → Subscription.
• We may suspend or terminate a workspace's access if these Terms are violated, if payment is significantly overdue, or if required by law.
• On termination, we'll work with the account's Admin on a reasonable data export or deletion timeline.

11. Limitation of Liability

To the extent permitted by applicable law, ThirdEyee's total liability for any claim arising from your use of the platform is limited to the amount your company paid us in the twelve months before the claim arose. We're not liable for indirect, incidental, or consequential damages.

12. Disclaimer of Warranties

ThirdEyee is provided "as is." We don't guarantee that the platform will meet every specific need, or that it will be free of every possible defect, beyond the commitments described in these Terms.

13. Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and, where appropriate, notify company Admins directly. Continued use of ThirdEyee after a change means you accept the updated Terms.
